Whom these terms bind, and what prevails in the event of a conflict
These terms govern the contracting of services through quickconvey.es, owned by Dalyko Partners, S.L. (NIF B21833264, Calle Navel 10, 03189 Orihuela, Alicante, daly@icam.es).
If they say something different from your engagement letter, the engagement letter prevails. It is the document you sign, the one that defines your specific matter and the one that sets the binding price. These terms are the general framework, not the contract.
The contract is concluded in Spanish, and the original of this text is drafted in Spanish.
What you are engaging, and what you are not
You are engaging legal services provided by a practising abogado (Spanish lawyer) registered in Spain, within the scope set out in your engagement letter.
What the published price does not include are the amounts that we do not charge and that are paid to third parties: taxes on the transaction, notarial fees, land registry fees, administrative charges and, where applicable, the costs of an outside gestoría (Spanish administrative agency). Those amounts are not fees and do not pass through our hands.
How the contract is formed
- You obtain a simulation in the price calculator. It is not a binding offer.
- If you confirm, you give us your name, your email address and your telephone number, we open your file and give you a reference number. There is still no contract.
- We contact you, review your specific case and send you the engagement letter with the fixed price and the scope.
- The contract comes into existence when you sign the engagement letter, not before.
Price, taxes and payment
The price in the engagement letter is fixed for the scope it describes. If work outside that scope arises, we will tell you before doing it and propose a price, which you may accept or decline.
Fees are stated inclusive of VAT, at the standard rate of 21%: the figure you see in the price calculator is the one invoiced. We issue an invoice for all our fees.
Payment is made by bank transfer to the account stated in the invoice or in the engagement letter, within the time limits set out in the latter. We do not ask for card details on this site or via WhatsApp; if you receive a payment request that does not come from one of our invoices, do not act on it and let us know.
Client funds: only if you ask us
By default we do not receive, hold or move our clients' money beyond our own fees. You pay the taxes and the notarial and registry fees directly to whoever is entitled to them, or your bank or notary does so; we calculate, prepare and file.
Only if you expressly ask for it when hiring us, with the option "I want to delegate all payments and retentions by providing money on account", do we pay on your behalf what you instruct us to, and then:
- we issue a request for money on account with its breakdown, estimated on the high side;
- the money on account is received in a client account separate from the firm's own and is used only for the payments you instructed;
- every payment, retention or release to the seller comes with its receipt, which you can see in your private area;
- we never pay with another client's money: if a payment exceeds your balance, we first ask you for additional money on account;
- at the end we give you a statement of account with every transaction and return the balance to you.
The transfer must come from an account in your name, and we may ask you to evidence the source of the funds under Ley 10/2010 (the Spanish anti-money-laundering Act).
Before we start, we must identify you
Where the transaction is subject to Ley 10/2010, de prevención del blanqueo de capitales y de la financiación del terrorismo (the Spanish Act on the prevention of money laundering and terrorist financing), we are required to identify you and to retain the documentation.
It is not a formality of our own and it does not depend on your consent or on ours: if we cannot comply with it, we cannot provide the service. We will ask you for it before we start, and we will tell you exactly which document is needed and why.
When we cannot accept the engagement
We do not accept a matter in which we have a conflict of interest —for example, if we are already assisting the other party to your transaction— nor any matter in which the Estatuto General de la Abogacía Española (General Statute of the Spanish Legal Profession) or the Código Deontológico (Code of Professional Conduct of the Spanish Legal Profession) prevents us from acting. If the conflict arises later, we will inform you and cease to act in the matter.
We may also terminate the engagement for good cause, giving you sufficient notice so that you are not left without legal assistance and returning to you the documentation you have given us.
Timeframes
We will keep you informed of the status of your matter and of what remains outstanding at every stage.
We do not promise timeframes that do not depend on us. Many steps in a purchase and sale —registration at the land registry, the response of the public authorities, the notary's schedule— are handled by a third party, and committing to their duration would mean committing to something that is not ours to commit. We do commit to the steps we take ourselves, and we will always tell you into which of the two categories each step falls.
If you are a consumer: your right of withdrawal
Where you contract at a distance or off-premises and act as a consumer, you have 14 calendar days to withdraw without giving any reason and without penalty, counted from the conclusion of the contract (art. 102.1 of the texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios, RDL 1/2007 —the Spanish consolidated General Act for the Protection of Consumers and Users, TRLGDCU—). If the contract is concluded following an unsolicited visit to your home, the period is 30 calendar days.
To withdraw, it is sufficient to inform us of your decision by an unequivocal statement —for example, an email to daly@icam.es— before the period expires. You may use the form reproduced below, but it is not compulsory.
And a warning in your interest, because this is where the right is lost without people realising it:
- If you expressly ask us to start before those days have elapsed and the service is fully performed within the period, the right of withdrawal is lost (art. 103.a TRLGDCU). And it is only lost if, in addition, we have informed you of this and you have acknowledged it.
- If performance has only begun, you may still withdraw and must pay us the proportionate amount for what has been done up to the time you inform us of your withdrawal (art. 108.3 TRLGDCU).
We will remind you of this in writing in the engagement letter, with the corresponding tick box.

Complaints and dispute resolution
Write to daly@icam.es. We will reply in writing.
As the services are provided by an abogado (Spanish lawyer) registered in Spain, you may also contact the Ilustre Colegio de la Abogacía de Madrid (Madrid Bar Association, ICAM), which has jurisdiction in matters of professional ethics over the professional conduct of the abogado, and the consumer affairs services of your autonomous community (region) or your local council.
We are not members of any accredited alternative consumer dispute resolution entity or of the Sistema Arbitral de Consumo (the Spanish Consumer Arbitration System). If your complaint is not resolved between us, we will inform you in writing, within one month, of an entity competent to hear it (art. 40 of Ley 7/2017, the Spanish Act on alternative dispute resolution in consumer matters).
Applicable law
Spanish law. If you are a consumer, you keep the benefit of the rules of jurisdiction that the law mandatorily recognises in your favour, including those giving jurisdiction to the courts of your domicile.
The four policies on this site share the same version, which is the one archived when you give your consent. The version changes only when the substance changes (a new purpose, a new recipient, a different retention period or a different legal basis); correcting a typo does not create a new version.
